Please read these terms carefully before using our services. By registering, logging in, or placing an order, you agree to be bound by these terms (or any separate agreement where applicable).

1. General provisions and scope of application

1.1 These Terms are entered into between you and VPSSpark (hereinafter referred to as "we" or "Platform") regarding the use of cloud Mac computing resources and related services provided by this platform (hereinafter referred to as "the Service").

1.2 This service is for individuals, businesses, or other organizations that can legally enter into contracts and bear responsibility. If you use it on behalf of a company, you represent that you have proper authorization.

1.3 Privacy Policy supplements these Terms with further rules on personal information. Please read the Privacy Policy.

2. Service Description and Order

2.1 The service includes, among other things, a remote Mac environment, network access, console access, and provisioning plus support flows tied to your order, configuration, and billing cycle. Specifics are governed by the package details page, pricing page, and order confirmation.

2.2 You choose model, billing cycle, data center, and add-ons on the pricing page and submit your order. We allow checkout before you sign in; you must complete account linking or registration in the follow-up steps, or delivery and support may be affected.

2.3 After payment succeeds, we provision resources through internal workflows (including tickets). Time to activate depends on stock, region, and review—this is not a guaranteed fixed deadline unless the order or a written agreement says otherwise.

3. Price, payment and billing cycle

3.1 The price is subject to the page displayed at the time of placing the order. The currency and tax description are subject to the payment channel and local regulations.

3.2 daily (and similar short-term) billing is usually a one-off purchase and does not auto-renew. Weekly / monthly / quarterly plans are subscriptions: unless you cancel before renewal under the product rules, they may renew and auto-bill the payment method on file. See the order and checkout screens for details.

3.3 You should complete the payment through the payment channels designated by the platform (such as Rainbow Easy Payment, etc.). Handling fees or exchange rate differences arising from third-party payment shall be handled in accordance with the rules of the payment institution.

4. Account and Security

4.1 You should properly keep your account number, password, verification code, API key and other information. You shall be solely responsible for any losses caused by your poor storage.

4.2 When you discover unauthorized use, please notify us immediately and modify the credentials. When we reasonably suspect that there is a risk, we may take measures such as restricting logins and freezing orders.

4.3 Use the sign-in popup’s password reset flow (email verification code) to change your password; follow the prompts and verification steps shown on the site.

5. Terms of Use and Prohibited Behaviors

5.1 You promise to use this service within the scope permitted by laws and regulations, and shall not use this service to engage in conduct including but not limited to the following:

  • Conduct that violates applicable laws in the jurisdiction where services are provided, where you are located, or that otherwise applies to you;
  • Infringe the intellectual property rights, privacy, reputation or trade secrets of others;
  • Spread malicious programs, conduct cyber attacks or conduct unauthorized penetration tests;
  • Send spam, scams, or otherwise harass;
  • Mining, brushing and other abusive behaviors that may affect resource fairness or platform stability (unless we give written permission).

5.2 We have the right to take warnings, speed limits, instance suspension, service termination, cooperation with supervision and other measures for illegal use, and reserve the right to pursue legal liability.

6. Data, Network and IP

6.1 You are responsible for backing up your data and meeting compliance obligations for what you store or process on an instance. For loss caused by force majeure, maintenance, or your own actions, our liability is limited to what the law allows.

6.2 Network quality, latency and availability are affected by many factors such as the public network and operators. We do not guarantee the experience in specific business scenarios unless the SLA is separately agreed.

6.3 IP addresses are assigned per the data center you select; wording such as dedicated IPv4 is defined in the product description. You must not use the service to send unlawful content or get IPs blocklisted.

7. Service changes, interruptions and terminations

7.1 We may change, suspend or terminate some services due to upgrades, maintenance, compliance or business adjustments. We will notify you through website announcements, emails or console prompts whenever possible.

7.2 You can unsubscribe or stop using it at any time according to the rules; whether to refund the paid but unconsumed portion shall apply to Article 8 and the special agreement of the order.

7.3 If you seriously breach the contract or are in arrears, we may suspend or terminate the service and reserve the right to seek compensation in accordance with the law.

8. Refunds, Disclaimers and Limitations of Liability

8.1 Refund eligibility, steps, and deadlines follow the supplements to these Terms, the order page, and replies from support or tickets. Some promo or custom orders may be marked non-refundable.

8.2 To the fullest extent the law allows, we are not liable for indirect or consequential damages, lost profits, data loss, or business interruption, except for our intentional misconduct or gross negligence where the law says otherwise.

8.3 We are not responsible for any service problems caused by force majeure, third-party service failure, your own reasons or matters beyond our reasonable control to the extent permitted by law.

9. Terms amendments and notices

9.1 We may revise these Terms. Major changes will be prompted through website announcements, pop-up windows or emails; if you continue to use the service after the changes take effect, you will be deemed to have accepted the revisions.

9.2 If you do not agree to the revision, you should stop using it and settle the fees.

10. Governing Law and Dispute Resolution

10.1 These Terms, and their formation, validity, and interpretation, are governed by the laws of the jurisdiction where the VPSSpark operating entity is incorporated, without limiting any mandatory consumer or other protections that apply to you.

10.2 Disputes arising from these Terms should first be resolved through good-faith negotiation. If negotiation fails, either party may bring the dispute before the courts of competent jurisdiction in that jurisdiction. If you are a consumer, nothing in this clause limits any non-waivable right to bring proceedings in your own jurisdiction where required by applicable law.
